Impose volunteer work in exchange for the RSA is found to be illegal – The World

The departmental council of the Haut-Rhin wished to impose on the recipients of the active solidarity revenue (RSA), from the 1st January, to work as a volunteer seven hours per week for associations, local communities or retirement homes. If they refused, the beneficiaries could be deprived of their allowance.

But this measure has been found to be unlawful, Wednesday, October 5, by the tribunal administratif, Strasbourg. The judge ruled that ” the department could not consider the condition, in general, the payment of the RSA in the performance of such volunteer work “.

Challenged by the prefecture

In a statement, the court also stated that ” if the RSA is assigned by the chairman of the board department and that the department assures the financing, the conditions to benefit from the RSA, however, are exclusively defined by the code of social action and families “.

This measure is very controversial had been made on 5 February by the departmental council, chaired by Eric Straumann (The Republicans). But the prefecture of the Haut-Rhin had challenged this decision in April.
