Rent control in Paris: a decline for a new tenant in five – Le Parisien

Established ” experimental “and limited to the capital where rents jumped by 42% in ten years, this device provides that the signing of a new lease or during a renewal, the rent for a unit can not exceed 20% rent a reference or be it 30% lower. Created by the Alur law of former Housing Minister Cécile Duflot, this device was originally to take effect in 28 tense areas. Prime Minister Manuel Valls has finally chosen to apply only within Paris.

Sometimes over 100 euros decline. According to the calculations of the Observatory of rents in the Paris region (OLAP), this will result in a rent decrease of up to 50 euros for third tenant signing a new lease of 50-100 euros for another third, and more than 100 euros for the remaining third. In the last third, the decline will be greater than 240 euros for 10% of the most expensive rents.

80 neighborhoods . The capital was divided into 80 districts (see map below) and a reference rent was set for each category of housing, according to its characteristics (number of rooms, construction time, naked or furnished rental). A practical guide will be online Tuesday, August 4.

An additional rent . The CLCV Association notes that “in some cases, the landlord may also apply in addition to the so-called additional rent, which is not limited. This supplement is only permitted for dwellings with characteristics specific location or comfort (terrace, rare sight, garden …) and provided the same category of housing around in are lacking.

A device still unclear. A decree published in June “attempted to clarify, but his writing remains cryptic” said CLCV. A Parisian tenant signs a new lease on 1 August or whose lease is renewed expressly, should learn about the maximum amount the owner is entitled to charge him. If the rent exceeds the limit, it may “indicate the lessor and maybe make a cross on housing,” says CLCV.

Challenging the lease. The tenant can also “sign the contract and then challenge”. He can then enter either the conciliation board or the trial judge, within three years from the signing of the lease. It can also challenge, within three months, the additional rent.

Appeals associations . Three organizations of real estate professionals, the Alps in the States and UNPI studying two appeals against the device, judging that its complexity will scare away investors. Conversely, an association fighting against poor housing chaired by the Regional Councillor of Ile-de-France EELV Julien Bayou filed two appeals to obtain a wider application of the device.
