The unions and employers will seek compromise Thursday channels to reach an agreement on social dialogue in companies, the final phase of a difficult negotiation that could lead to a “revolution”: a single instance of employee representation
The employers’ organizations (MEDEF. CGPME, UPA) and trade unions (CGT, CFDT, FO, CFTC, CFE-CGC) occur at 9:30 am at the MEDEF. They have only two days to conclude an agreement to obtain the approval of unions totaling at least 30% of the vote.
Over the last two meetings, the MEDEF employers’ side stands alone.
A new text to be presented Thursday to the unions. It could have the endorsement of the UPA (craftsmen), but the CGPME said that it looks “very complicated” for her.
The chamber wants to drastically revise the representation of staff, simplifying the famous social levels, creating new obligations on the number of employees.
It aims to create a single instance, the “Executives”, merging the current corporate committee, the Committee for health, safety and working conditions (HSC), delegates staff and union representatives. This body, which would be in place from the 11th employee, would aim to negotiate enterprise agreements

“In my opinion, most large companies expecting this tool,” he said, acknowledging that the smaller “are not necessarily asylum.”
For the CGPME, MEDEF text does not forbid the interests of small and medium enterprises. The organization was not against the original document which proposed that the “Executives” snaps into place from the 50th employee (not the 11th). She also fears that a representation “formalized” in the TPE will harm the social dialogue.
For now, discussions stumble mainly on the issue of representation in TPE, which it is for the ‘nonexistent hour. Unions claim it and CFDT in particular warned in December that “if nothing (was) proposed” for small, it “does not envisage (has) not to sign.”
In late December, MEDEF negotiator Alexander Saubot said he would accept “in no case” to create new obligations for small, noting that there was “already external representation arrangements with the company.” These, like the inter-regional joint committees crafts (CPRIA) could be developed

In a statement, the CFE-CGC warns that it will be “particularly vigilant” on the subject. She says she is ready to “simplify, modernize” social dialogue, but “provided you do not lose (its) en route militants” and “working conditions in passing.”
The CGT announced that it will be “inflexible on the autonomy of the different” bodies including the HSC. A group of trade unionists and workplace health actors also took the pen to defend this “fundamental collective tool to allow workers to speak and act on working conditions.”
The unions do not see a good eye restrictions on the expertise that can claim the EC, in particular the idea that 20% of the cost is borne by the EC, where the employer paid only up to now.
With or without agreement, the government, which says it wants to simplify the social dialogue, “too often formal,” to facilitate employment, has already announced a law in the second quarter.
The unions warn employers that he faces a “big disappointment” if the Executive takes over. And some rely on “the spirit of January 11″ for harmony, like the union executives who hope that the employers will hear his proposals “given the events of last week.”
For the CGT, it would be a mistake to believe that the period should lead to a “sacred union” with management.
