Corruption, the State Council waters down the Sapin law – France Info

This bill is intended, overall, to fight against corruption, but the device of “plea bargaining” will be excluded. This device would allow companies implicated in corruption cases, to avoid a criminal conviction enabling them to recognize their twist (plead guilty), and paying a fine equivalent to 30% of turnover average over the last 3 years. The government will finally renounce this measure inspired by the American right
Why this revision
The principle has stumbled before the Council of State which questions! NGOs like Oxfam France, and unions (Solidaires Public Finance, Union of Magistrates, etc …) opposed it, citing a “lack of responsibility” in the face of corruption. Michel Sapin has decided to back off, leaving the final choice to parliamentarians during the debate in the National Assembly. A discussion that will put it on the front of the stage and allow can finally return to the original text of partially modified in the desired direction by Bercy.
France is
delay
two years ago already, the OECD (Organisation for economic Cooperation and Development) which includes thirty countries had deemed insufficient means developed by France in the fight against corruption in the economic environment . Paris was accused essentially manifest reluctance to prosecute companies tricolor. Balance sheet, some French companies are condemned abroad but not in the righteousness of their own country. In recent years, this was the case for groups such as Total, Alcatel and Technip in the United States … A paradox, or gap, that would fill Michel Sapin. The Council of State ruled but not the parliamentary debate.
