In his hurdling for the Labour Law, the government faces this week two new events – The Huffington Post

POLICY – For over a month and a half as the debate rages about a bill that was officially presented last week. And after this week ahead to new decisive for the future of the Labour law, there will still be more than a month for opponents to try to move the lines, the text to be examined at the National Assembly late April -may’s beginning.

Before considering the verbal jousting in the Chamber, the government will face this week two new tests, two new hurdles on the path of adopting the text without recourse to Article 49-3 : Tuesday, March 29 he will be able to measure the reception of deputies commission. Thursday 31 is the determination of their opponents that will evaluate Manuel Valls and Myriam El Khomri, to which the unions have promised a “very big mobilization” in the streets.

On Tuesday, the text will be decrypted by the Social Affairs Committee of the Assembly with the expected hearing Myriam El Khomri, even though some are still wondering if the minister is fully convinced by law it must defend. Wednesday, the hearings will continue with those unions (CGT, CFDT, CFE-CGC, FO, CFTC) and Employers (MEDEF, CGPME UPA).

If the concessions made last week by the government of Manuel Valls calmed some claims of stumbling blocks remain. In Parliament, the rapporteur Christophe Sirugue intends to amend the text. Developments that always defended the minister, who thinks that “there are still things to improve” and relies on the parliamentary debate to “enrich” the text.

The parliamentary debate, the “rebellious” count it. The few members of the left wing of the Socialist Party remaining in the Committee on Social Affairs will attempt to promote their “cons-reform” for “the future of work” presented last Wednesday. However, the government’s room for maneuver is tenuous because it must also reckon with the employers, who protested against the new version, “not acceptable in the state.” For CGPME, the proposed measures will have “virtually no essentially positive impact of French companies.”

What will be discussed yet:

– Redundancy: The text specifies the reasons for redundancy: four quarters consecutive decline in orders or sales, two consecutive quarters of operating losses. The difficulties of a group will be evaluated on its own French subsidiaries, the government stepped in providing that the court must verify that the company does not organize the “artificially” to dismiss. Trade unions call for more specific provisions

– Corporate Referendum. A business agreement will be “majority” that is to say, signed by unions representing over 50% of employees in professional elections. Lack of majority, minority unions (over 30%) may request a corporate referendum to validate the agreement. The UNSA calls for the withdrawal of this article, saying that referendums may “cleave employees”

– The measures on working time. The primacy of the company agreement on working time becomes a principle. This “reversal of the hierarchy of norms” is denounced by union protesters and part of the left. Among the changes, a working day of 12 hours (against 10) is possible, but the criteria are specified. The possibility of moving to a weekly average of 46 hours of work (instead of 44) for 12 weeks is relaxed. A company agreement may fix the rate of increase overtime at 10% instead of 25% usually charged. However, in the absence of agreement, the current law will apply. The government initially planned to introduce a supplementary law less favorable than the current law, to encourage negotiation.

“Very, very big mobilization” vs “Day” tote “

” Thursday, it will by no means a last stand, “says Eric Beynel, spokesperson for Solidarity, which has called for the mobilization alongside CGT, FO, FSU, the UNEF, and LDIFs UNL high school students’ unions. He promises “a very, very big mobilization on 31 March, larger than that of 9 March”, where more than 200,000 people marched in Hexagon (450,000 according to the organizers).

Sunday, Laurent Berger, leader of the CFDT union close to the government, he described the March 31 day “catch-all”. according to him, day also aims “to three weeks of the congress” of the CGT in Marseille, “to tighten a little in-house ranks.” the CFDT will “continue to make proposals” to influence the project, he said Monday. others could follow mobilizations against “social regression” of the bill.

events are planned throughout France and the Paris of Italy will start at 14h instead of to Nation. Philippe Martinez, leader of the CGT, and Jean-Claude Mailly (FO) will participate in the procession. Protesters environmentalists MPs will be also present. As well as CFDT and CFE-CGC militants, against the current of their respective plants. Mobilizing broad promises: officials, ports and docks, Air France employees are required to stop work, as RATP, this time to wage issues. The slogan will be “repeal law” as too favorable to employers.

Opponents of the text denounced, among other items of “easing the benefit of the employer of dismissal rules”, rules on working time by prioritizing enterprise agreements on those branch (penalty, package-day break …) and the creation of business by referendum.
