The Prime Minister announced 18 measures to ease constraints on small businesses, at a cost of 200 million euros.
The government hopes to boost employment in the SOHO and SMEs. Manuel Valls announced Tuesday 18 simplification measures to these companies, after a Council of Ministers restricted on employment in small and micro businesses. In times of rising unemployment, these companies, which employ to date a French employee in two, are indeed the government’s eyes a “job opportunities” that aims to stimulate good. Manuel Valls detailed the five strongest measures of its “French Small Business Act to” the cost should be around € 200 million.
• Exceptional aid to hiring an employee 1
To help the 1.2 million enterprises with no employees to take the plunge, Manuel Valls announced Tuesday exceptional assistance. A premium to hire 4,000 euros, paid in two installments – the first year 2000 euros and 2000 euros the following year – they will be paid when hiring their first employee
As expected, the government will introduce an amendment in the law that Macron will cap the compensation awarded by industrial tribunals in If an employee contests his dismissal is upheld. These benefits vary greatly effect from one court to another – sometimes doubled to a similar case – which is a major source of uncertainty for entrepreneurs, especially the small ones.
On this point, the government has strongly inspired by his Italian neighbor. A minimum and maximum indemnity compensation will be determined depending on the size of the company and the employee’s seniority. In total, they will now vary from two months salary to 20 months salary according to these criteria. The government plans to establish, with parliamentarians, different rules for the largest companies, employing more than 250 or 300 employees – the threshold remains to be refined. That’s life of small businesses should be simplified, said Manuel Valls. This scale not otherwise constrained concern the most serious cases that have to know the tribunal. In cases of harassment of an employee by his employer or discrimination, the judge may still order the payment of compensation heavier.
• The possibility to renew a fixed term contract twice, against a Only once today
The government had warned that he would not create new employment contract. “There are already a lot,” said Manuel Valls. The government still gives at least partial satisfaction to the employers, giving employers the opportunity for greater use of fixed-term contracts (CDD). Each CSD will henceforth be renewed twice, once against today. Nearly 85% of new recruits are now made in CSD. If the proportion of CDI employees has been stable for 15 years, businesses have recourse instead to CDD increasingly short.
Manuel Valls has also made an expected accuracy for the test period of apprentices, which lasts two months. It now systematically start from the entrance of the apprentice in the company, and not from the signing of his contract. “Some young people out of school and arrived in the company as they have already completed their trial period,” says Manuel Valls.
• A period of three years to encourage companies to cross the thresholds of 11, 20 or 50 employees
On the issue of thresholds, the government wants to go further than the timid bill carried by the Minister of Labour, François Rebsamen. “We are continuing the work of the law by acting on Rebsamen other effects of these thresholds.” The crossing of thresholds 11, 20 and 50 employees starts in fact, besides new obligations in social dialogue, increased social and tax deductions.
To make the pill less hard to swallow for those companies, Manuel Valls plans to grant them a period of three years to fulfill these new responsibilities. “Now, companies that pass a threshold will not see their situation change for three years,” Manuel Valls guarantees.
A report by the German IFO institute recently released however emphasized that “a temporary freeze on new obligations for companies that pass above a threshold to encourage increased use of temporary recruitment new employees, in order to return below the social floor once the temporary freeze up. ”
• Controls strengthened to fight against unfair competition of posted workers
The fight against fraud to posted workers will finally be strengthened, promised the first Minister. “I am struck by the extent of the phenomenon. Some sectors, such as construction or agriculture, are particularly concerned. We have strengthened our fight plan against fraud. But today we take more drastic measures. ” Besides control and increased sanctions against fraudsters employers, Manuel Valls wants a payer can be held responsible for abuses of its subcontractor. The relationship between contractors and subcontractors will also be on the agenda for a social conference to be held in the fall.
